Terms of Service

These Terms of Service ("Terms") govern access to and use of the Pluddy website, applications, and related services (the "Service") operated at www.pluddyonline.com("we", "us", "Pluddy"). By accessing or using the Service, you agree to these Terms. If you use the Service on behalf of a school or other organisation, you represent that you have authority to bind that organisation, and "you" includes that organisation.

1. The Service

Pluddy provides AI-assisted Polish language practice tools for language schools, teachers, and students — including chat tutoring, drills, curriculum-aligned practice, and related dashboards. Features may change as we improve the product. Pilots and paid plans are described on our website or in a separate order / pilot agreement.

2. Accounts and access

  • You must provide accurate account information and keep credentials confidential.
  • Schools are responsible for inviting the right users, managing roles, and ensuring students (or parents/guardians where required) are authorised to use the Service.
  • You must not share accounts in a way that bypasses seat / plan limits or security controls.

3. Intellectual property — our platform

The Service — including software, UI design, branding, logos, documentation, prompts, workflows, and original content we create — is owned by Pluddy or our licensors and is protected by copyright, trademark, and other laws.

You may not copy, scrape, mirror, reverse engineer, decompile, resell, sublicense, or create competing products from the Service or our materials, except where mandatory law allows limited reverse engineering. You may not remove proprietary notices.

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service during an active pilot or subscription solely for your internal educational purposes.

4. Intellectual property — school content

PDFs, curricula, notes, textbooks references, and other materials you upload ("School Content") remain your (or your licensors') exclusive property. We do not claim ownership of School Content.

  • You grant us a limited licence to host, process, and display School Content solely to provide the Service to your school (including temporary AI processing to generate exercises).
  • We will not sell, share, or redistribute School Content to other schools or third parties for their own use.
  • We do not use School Content to train or fine-tune our own foundation models. AI features call the Google Gemini global API; under Google's paid API terms, inputs/outputs are not used to train Google's generative models. Processing may occur outside the EEA. We do not claim EU-only AI data residency while using the global Gemini endpoint.
  • School environments are logically isolated; one school cannot access another school's materials.

You represent that you have the rights to upload School Content and that doing so does not infringe third-party IP or privacy rights.

5. Acceptable use

You agree not to:

  • Use the Service for unlawful, harmful, or abusive purposes
  • Attempt to access other schools' or users' data
  • Upload malware or attempt to disrupt or overload the Service
  • Automate access (bots, scrapers) without our written permission
  • Misrepresent AI output as human-created exam answers where that violates school rules
  • Use the Service to build a competing product using our outputs or design

6. AI output and educational results — no guarantees

The Service uses artificial intelligence. Outputs may be incomplete, incorrect, or inappropriate for a given learner. Pluddy is a practice and support tool, not a substitute for qualified teachers, official exams, or professional advice.

We do not guarantee exam pass rates, grades, admissions outcomes, fluency levels, or any specific learning result. Schools remain responsible for pedagogy, assessment, and decisions about students.

7. Availability and changes

We aim for reliable uptime but do not warrant uninterrupted or error-free operation. Maintenance, third-party outages (hosting, AI providers), or force majeure may affect availability. We may modify or discontinue features with reasonable notice where practicable.

8. Fees, pilots, and taxes

Paid plans, pilots, invoices, and renewal terms are as agreed in writing or shown at purchase. Unless stated otherwise, prices are exclusive of VAT and applicable taxes. Non-payment may result in suspension.

9. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY — INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of liability

To the maximum extent permitted by applicable law, Pluddy and its operators shall not be liable for any indirect, incidental, special, consequential, punitive, or lost profits damages, or for loss of data, goodwill, or business opportunity, arising from the Service or these Terms — whether based in contract, tort, or otherwise.

Our total aggregate liability arising out of or relating to the Service or these Terms shall not exceed the greater of: (a) the fees you paid us for the Service in the three (3) months before the claim, or (b) one hundred euros (€100) if you are on a free pilot with no fees paid.

Nothing in these Terms excludes or limits liability that cannot be excluded under mandatory law (including liability for death or personal injury caused by negligence, fraud, or wilful misconduct).

Schools agree that claims related to student outcomes, curriculum quality decisions, or exam results are outside our liability as described above, except where mandatory law provides otherwise.

11. Indemnity

You agree to defend and indemnify Pluddy against claims, damages, and expenses (including reasonable legal fees) arising from: (a) your School Content; (b) your misuse of the Service; (c) your breach of these Terms; or (d) claims by your students, staff, or parents related to your use of the Service, except to the extent caused by our wilful misconduct.

12. Suspension and termination

We may suspend or terminate access for material breach, abuse, non-payment, or legal risk. You may stop using the Service at any time. Upon termination of a school subscription, we will delete or return School Content in line with our Privacy Policy and any signed DPA (typically within 30 days after the retention period ends, unless law requires longer retention).

13. Privacy

Personal data is handled as described in our Privacy Policy. For school deployments we typically act as a processor; schools act as controllers of student data.

14. Governing law and disputes

These Terms are governed by the laws of Poland, without regard to conflict-of-law rules. Courts in Warsaw, Poland shall have exclusive jurisdiction, except where mandatory consumer-protection rules give you other rights.

15. Changes

We may update these Terms by posting a new version on this page and updating the "Last updated" date. Material changes for active school customers will be communicated by email where practicable. Continued use after the effective date constitutes acceptance.
